Privacy Policy

This Privacy Policy (“Privacy Policy”) describes the approach of Estate.Studio, LLC D/B/A Estate.Studio (“Estate.Studio”, “us”, “our” or “we”) to Privacy and provides information about how we collect, use, process, and disclose personal information.  By using any of our Services, which are as defined in our Terms and Conditions (“Terms and Conditions”) linked here, you acknowledge the privacy practices we describe in this Privacy Policy. You also acknowledge that you have read this policy and other policies described herein.

 

  1. What This Privacy Policy Covers. This Privacy Policy describes how we use personal information in connection with goods and services offered and sold by Estate.Studio through our Services, including, without limitation, your use of the Site (as defined in our Terms and Conditions) (including mobile versions thereof) and through your online interactions with us, unless otherwise indicated below.

 

  1. Activities not covered by this Privacy Policy. This Privacy Policy does not cover the following activities: 
  • Personal information that may be collected or used by other businesses when you click on third-party links found on our website.  You can refer to the privacy policy of third-party websites and services for information about their privacy practices.

  • Personal information that may be obtained from third parties whether our affiliates or otherwise.

  1. Estate.Studio’s Approach to Privacy. We take your privacy seriously and are mindful of potential concerns about how we use the personal information that we collect from you. In addition to this Privacy Policy, we have taken commercially reasonable steps to keep your personal information secure and to ensure that information about you is only used consistent with this Privacy Policy. 

 

  1. The Information We Collect. The specific information that we may collect about you depends on the type of interaction and the types of products considered or purchased. Estate.Studio may collect the following types of personal information:

 

  • Identifiers. Examples of the types of identifiers that we may collect include real names, nicknames, postal addresses, online identifiers, Internet Protocol (IP) addresses and email addresses.

 

  • Sensitive Information. Examples of the types of sensitive information that we may collect include usernames and passwords for accounts connected to Estate.Studio, information you input into any of our Site or other Services, such as, without limitation, your personal information, estate information, family information, estate planning information, insurance information, information about your income, assets and liabilities, financial information real and personal property information. 

 

  • Characteristics Protected Under Some Laws. Examples of the types of characteristics that we may collect include age, national origin, citizenship, marital status, gender, citizenship, and veteran or military status.  We do not use this type of information to analyze your health, sex, gender identity, or sexual orientation; however, we do use this information in order to provide you with helpful suggestions if it may benefit you with regard to estate planning. By using our Site or other Services, you expressly authorize us to use this information in this way and irrevocably waive any objections relating thereto. 

 

  • Commercial Information. Examples of the types of commercial information that Estate.Studio may collect include records of business, finances and interests in real and personal property, products or services purchased, obtained, or considered from Estate.Studio or our partners, and other purchasing or consuming histories or tendencies.

 

  • Internet Information. Examples of the types of internet activity information that we may collect include browsing history, search history, information about the device used to access or interact with our Site or other Services or advertisements. We may also collect information from visitors to our Site or other Services, such as browser settings, operating systems, referring/exit pages, and clickstream data.  When we send you an email, we may also collect information, including about how you interact with that email.

 

  • Geolocation Information. We may collect information about where you reside or are otherwise located.

 

  • Professional and employment-related information. Examples of the types of professional and employment-related information we may collect include information about professional status and affiliations, licensure, employment history, salary and employment status.

 

  • Other Types of Information. Examples of other types of information that we may collect include physical characteristics or descriptions of you, telephone number, insurance policy number, financial information including bank account, credit card, and debit card numbers, and health and other insurance information. It may also include additional information provided to us directly by you, such as when you complete an assessment, questionnaire or survey, or input information into our Site. This category includes information identified as personal information in California Civil Code Section 1798.80(e) that is not otherwise categorized above.

 

  1. Where We Collect Personal Information. Estate.Studio may collect information from various sources, which are explained more below.

 

  • Customers: Much of the personal information that Estate.Studio collects is directly or indirectly obtained from you via any number of our Services, including, without limitation, chats, questionnaires, forms, Site and Portal (as defined in our Terms and Conditions).  We may also collect information indirectly about you when you interact with our Site, or from others’ input in connection with their use of our Services, as well as using cookies and other tracking technologies, which are discussed below in the section entitled, “Estate.Studio’s Use of Cookies and Similar Technology, and Your Choices.”

 

  • Related Parties: We may collect information about you from someone you know.  You may provide us with information about your business or real estate, which may include information about your partners and co-owners. 
  • Service Providers: We may collect information about you from our service providers or other companies that we work with to deliver products to you.  As used in this Privacy Policy, service providers means entities with whom Estate.Studio has contracted in order to provide us with services to help fulfill our business needs. Below is a non-exclusive list of our many of our service providers and their corresponding privacy policies.

 

 

  • Professionals (including attorneys and other estate planning professionals): We may receive information about you from the attorneys and other professionals with whom you have a relationship. Estate.Studio does not intend to and is not responsible for the collection any of your information from these professionals where the collection would result in a waiver of a privilege, such as, without limitation, attorney-client privilege.  

 

  • Business Partners: We may receive information about you from our Business Partners.  As used in this Privacy Policy, Business Partners means entities with whom Estate.Studio has contracted in order to engage in cross-promotional, product integration activities and adverstising. An example of the type of information that we may receive from our Business Partners is information about the products you purchased from them or information you submitted to them in connection with your use of our Services.

 

  • Affiliates and Subsidiaries: We may receive information about you from our affiliates and subsidiaries.  For example, if we acquire an ownership interest in a company, we may receive information about you as part of that acquisition if you have previously done business with them.

 

  • Publicly/Commercially Available Information: We may collect information about you from publicly available sources of information, including government records, verification services, credit bureaus, advertising networks, service social media sites, and other commercially available sources of personal and professional information.  
  • Information We Obtain from Other Sources: The information we may receive from third parties varies depending on the information made available by those entities. Examples of the types of information we receive include financial account information, information about account balance, information about credit accounts, information about loan accounts, information about investment accounts, identifiers and information about account owners, information about account transactions and employment information.
  1. How We Use the Personal Information We Collect: in this section of the Privacy Policy, we explain our commercial and business purposes for collecting information. We use the information we collect to provide our Services to you. Such uses are described below and we may combine information that we have collected from multiple sources to fulfill these purposes. If we decide to use the personal information we have collected for additional purposes that are inconsistent with what is described below, we will let you know of our plans and give you information about your legal rights regarding your personal information.

 

  • Providing Products and Services: We use personal information to provide and support our products and Services and help you improve your estate planning health and reduce your estate planning risk. Examples of these uses include using personal information to make product or action-oriented suggestions, as well as producing and delivering documents purchased by customers, administering the Estate.Studio Site, and displaying content based on customer preferences. 

 

  • Security: We use personal information to ensure that we maintain appropriate security over computer networks, data storage and our physical facilities, as well as detecting fraud or other suspicious activities.

 

  • Marketing and Advertising: We use personal information for marketing and advertising to current and prospective customers, which may include, without limitation, suggested estate planning tools, instruments, documents, products, services, professionals, companies, whether through our Business Partners or otherwise. More information about how you can control the use of your personal information for marketing purposes can be found in the section entitled, “Estate.Studio’s Use of Cookies and Similar Technology, and Your Choices” and “Your Options Regarding Personal Information Collected by Estate.Studio.”’

 

  • Product Development: We use personal information for product development, including improving our existing products and developing new ones.

 

  • Analytics: We use personal information for various types of analytics. For example, Estate.Studio uses personal information to analyze how visitors arrive at and interact with our website, and to gain insight into the types of customers that may be interested in our products and services. We may also use the information to develop inferences from the information we collect regarding customer preferences, characteristics, predispositions, behaviors, and attitudes.

 

  • Operational Purposes: We use personal information for operational purposes, and the operational purposes of our service providers, Business Partners, affiliates, and subsidiaries. For instance, Estate.Studio may use the information to maintain our website and other infrastructure, training, quality assurance, for conducting surveys or sweepstakes, to promote our brand, and to use in connection with our relationships with service providers and Business Partners.

 

  • Financial Reporting: We use personal information in connection with various types of financial reporting and other similar internal uses. Examples of the types of financial reporting that Estate.Studio may use personal information including internal budgets and projections, compensation calculations, and public reporting.

 

  • Meeting Legal Requirements: We use personal information to meet our legal obligations, such as performing customer due diligence and maintaining records.

 

  • Plaid Technologies: We enable you to use Plaid Technologies, Inc. to gather data from financial institutions. By using the Services, you acknowledge and agree that your information will be processed in accordance with the Plaid Privacy Policy and you grant us and Plaid the same rights, power and authority as specified therein.

 

  • Business Transfers: If Estate.Studio undertakes or is involved in any merger, acquisition, reorganization, sale of assets, bankruptcy, or insolvency event, then we may sell, transfer, or share some or all of our assets, including information related to customers in connection with the transaction or in contemplation of the transaction (such as conducting due diligence). If such an event occurs, your information may be treated like any other Estate.Studio asset sold, transferred, or shared with third parties, or used in ways not contemplated or permitted under this Privacy Policy. In this case, you will be notified via email and/or a prominent notice on our site of a transfer of a controlling interest in the Company or uses of your personal information, as well as any choices you may have regarding your personal information, including, without limitation, deleting your account.

 

  1. How We Disclose Personal Information: In this section of the Privacy Policy, we explain to whom we disclose personal information and under what circumstances we may make a disclosure.

 

  • Service Providers: We may share personal information with our service providers who assist us with running our business. These companies are not authorized to use the information we share with them for any purpose other than providing services to Estate.Studio or to you.

 

  • Businesses Providing Services: Estate.Studio may disclose personal information with other businesses in order to provide you with products and services. Personal information disclosed to other businesses will be subject to those third parties’ privacy practices. For instance, we may provide personal information to companies offering disability insurance or life insurance. Likewise, we may use Stripe for purposes of processing payments or providing identity verification services. In doing so, our payment processor, Lemon Squeezy, may collect and process personal information for its uses, including improving its services and for fraud detection and prevention.

 

  • Professionals (including attorneys and other estate planning professionals): We may share personal information with attorneys and other estate planning professionals whose services can be accessed through our Services. 

 

  • Business Partners: Estate.Studio may share personal information with business partners. When we share personal information with business partners, it will generally be subject to their privacy policy. We share information with business partners in the following circumstances:

 

  • If you express interest in an offer presented to you either by Estate.Studio on behalf of a business partner or by a business partner on behalf of Estate.Studio, you are directing Estate.Studio to provide information about you to that business partner.

 

  • If you purchase an Estate.Studio product that is bundled with a product offered by one of our business partners, we will share relevant information about you with that business partner.

 

  • Parties Related to You: In limited circumstances, we may provide information about you to someone you know. For instance, we may provide information connected to your Estate.Studio account with your authorized contacts. Likewise, your family or someone you know may provide us with your personal information if they are users and you are a trusted contact or family member.

 

  • Government Entities: Estate.Studio does not share any information about our users with government entities except to the extent that Estate.Studio is subject to a court order compelling such disclosure. 

 

  • Public Disclosures: Estate.Studio does not publicly disclose any personal information except possibly User-Generated Content (as defined in our Terms of Use), which is subject to the terms and conditions in our Terms of Use. 

 

  • Publicly Disclosed information. We may display testimonials and reviews received through email surveys on our Site or other marketing or that are posted to publicly available websites.

 

  • Forums: When you post content in any forum or comment area on our Site, these posts may be publicly available. You should use caution when deciding whether to disclose your personal information in public areas of our Site. When we collect publicly available information, we may share that information on our Site. For more information regarding User-Generated Content, please consult our Terms of Use.

 

  • Required by Law: Estate.Studio may disclose personal information as required by law, such as in response to a subpoena or a lawful request by a public authority, including to meet national security or law enforcement requirements, or similar legal processes.  We may also disclose personal information when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a legitimate request from a government entity.

 

  • Parties Related to Estate.Studio: Estate.Studio may disclose personal information with businesses controlling, controlled by, or under common control with Estate.Studio. If Estate.Studio is merged, acquired, or sold, or if some or all of our assets or equity are transferred, we may disclose or transfer consumer data in connection with the associated transactions.

 

  1. How Long We Retain Your Personal Information. Estate.Studio retains your personal information for at least as long as it is reasonably necessary to fulfill the purposes for which we collected the data, to provide you with services and products, to comply with our data retention obligations, and to successfully run our business.

 

  1. Estate.Studio’s Use of Cookies and Similar Technology, and Your Choices. Like all online companies, Estate.Studio uses a range of technologies in connection with your use of our Services and Site (as defined in our Terms of Use). The types of technologies that we may use include cookies, web beacons, tags, Urchin Tracking Modules (UTMs), scripts, local shared objects such as HTML5, advertising identifiers (including mobile identifiers such as Apple’s Identifier for Advertisers (“IDFA”) or Google’s Advertising ID (“GAID”)), and similar technologies, which for purposes of this Privacy Policy we refer to as “Cookies.”

 

  • We use Cookies, either directly or through our service providers, for a variety of purposes. Depending on the purpose, you have different options regarding whether and how we use Cookies to collect your personal information.

 

  • Cookies are small data files stored on your hard drive or in device memory that help us improve our Services and your experience, see how you engage with our Site and Services, see which areas and features of our Services are popular and which emails and advertisements you view, authenticate users, reconstruct or observe activity relating to a session or by a user for troubleshooting, issue resolution, and other purposes, and count visits to our Site.

 

  • Web beacons (also known as “pixel tags” or “clear GIFs”) are electronic images that we use on our Services and in our emails to help deliver Cookies, count visits, and understand usage and campaign effectiveness. In our Mobile Apps, we may also use technologies that are not browser-based like Cookies.

 

  • By way of example, our Services may include by our service providers the use of software development kits (often known as SDKs), which are code that sends information about your use to a server. These SDKs allow us to bring you advertising both on and off the Services, and provide you with additional functionality. 

 

  • Strictly Necessary Cookies: We use Cookies to help our website operate and for security purposes. Due to the nature of these Cookies, you do not have the ability to opt-out of the use of these Cookies.

 

  • Performance and Functionality Cookies: We use Cookies to provide enhanced functionality on our website and app, to personalize your experience, to collect information for analytical purposes to help us improve and develop products, and to help us understand how you are engaging with our products. If you reject these Cookies, the functionality of our website may be impacted, including in ways that may limit your use of our products and Services.  

 

  • Engagement and Marketing Cookies: Estate.Studio and our service providers, such as Google Analytics, use Cookies to help us understand how you engage with our marketing and to help provide you with relevant marketing about our products when you visit other websites, including through targeted advertising. 

 

  1. Your Options Regarding Personal Information Collected by Estate.Studio: This paragraph and the following paragraph 10 describe how you can access and control the information that Estate.Studio may have about you. It applies to all consumers worldwide, including individuals who have purchased goods or services from Estate.Studio or who believe that information about them may have been provided to us by a third party. Depending on where you reside, you may have additional rights beyond what is described in this section.  If you are a resident of California or Virginia, please review the section entitled, “Information for California and Virginia Residents” for more information about your rights.

 

  1. Confirmation of Possession of Information Related to You. Upon a verified request, subject to the privacy interests of others and technical limitations, Estate.Studio will provide you with information about whether we hold any information related to you. At Estate.Studio’s sole discretion, unless otherwise required by law, we may, in some instances, correct or delete information upon a verified request. Please note, however, that in certain circumstances, we may be required by law to retain your personal information or may need to retain your personal information to continue providing a product or service to you or another customer.

 

If you would like to submit a request about your data, you may do so by emailing datacontroller@estate.studio. After you submit the request, you will be asked to verify your email address and may also be asked to provide additional reasonable information to verify your identity as we determine under the circumstances.

 

  1. User and Authorized Contact Access to Portal Information. Estate.Studio will give you, or anyone listed as a trusted representative authorized contact for your account, information about your Portal information. This may include information about the nature and status of your Portal, the information you provided to process your order, payment information, and contact information. If you want someone to have access to your Portal, you must list them as a trusted representative, or they may not obtain such information. You can confirm who is listed as a trusted representative for your account, add new trusted representatives, or remove trusted representatives in your profile. We may send a confirmation email to your trusted representatives alerting them that they have been added as a trusted representative. 

 

  1. Opting Out of Promotional Email. You can opt-out of promotional emails by using the “Unsubscribe” link and following the unsubscribe instructions in an email you receive from us or by emailing us at support@estate.studio. We may also send Services-related or transactional communications, which are not promotional. Generally, you may not opt-out of these communications. If you do not wish to receive Services-related communications, you may terminate your account online.

 

  1. Estate.Studio’s Security and Identity Verification Practices. Estate.Studio is committed to protecting the personal information that we collect and ensuring our Services are provided in a secure manner. We have implemented security measures designed to protect the personal information that we maintain. This includes implementing physical, technical, and administrative safeguards to secure the information we collect. We use industry-standard SSL/TLS to transmit payment card information. We also regularly monitor our systems for possible vulnerabilities and attacks.

 

Importantly, regardless of the measures and efforts that Estate.Studio takes to protect personal information, we cannot guarantee absolute protection and security of your personal information. We encourage you to take precautions in protecting the information that you share with Estate.Studio. For example, we encourage you not to allow others to use your email without your express consent.  

 

If you believe that you have discovered a security vulnerability in our Site or Services, you may let us know at support@estate.studio. If you believe that someone has accessed your personal information or that your personal information has been misused, please let us know immediately by contacting us at support@estate.studio.

 

  1. Information for California and Virginia Residents. If you are a resident of California or Virginia, this section provides information regarding your rights, and Estate.Studio’s responsibilities, regarding your personal information. 

 

California and Virginia Residents’ Rights

 

If you live in California or Virginia, you have certain rights regarding your personal information.  This includes the right to request:

 

  • Specific information about what information Estate.Studio has collected about you,
  • A copy of your personal information,
  • Corrections to inaccuracies in the personal information Estate.Studio maintains about you, and
  • The deletion of your personal information.
  • These rights are not absolute, and in some circumstances, Estate.Studio may decline to satisfy your request. For example, if we are unable to verify your identity or if your request impacts other people’s privacy rights, we may deny your request to exercise these rights. We may also deny your request when Estate.Studio has the legal right to do so, such as when we have an ongoing business relationship with you, an ongoing need to use the information for purposes outlined in this Privacy Policy, or we are legally required to retain your personal information. If Estate.Studio denies your request to exercise your privacy rights, we will tell you why we are denying the request and provide you with information about how to appeal this decision.

 

If you choose to exercise your privacy rights, we will not charge you different prices or provide a different quality of services unless those differences are related to your personal information.

 

How to Submit a Request for Access, Correction, or Deletion of Personal Information

 

If you would like to submit a request about your personal information, we encourage you to do so by submitting a request to us by emailing support@estate.studio.

 

After you submit the request, you will be asked to verify your email address and may also be asked to provide additional information to verify your identity. Estate.Studio will attempt to verify your identity by asking for information that correlates with the information that we have previously collected about you. If this is not possible, Estate.Studio may request you submit additional reasonable information for verification, such as proof of residency or redacted government-issued identification.

 

You may also designate an authorized agent to make a request on your behalf.  To designate an authorized agent, you must provide Estate.Studio with written permission for the agent to make the request on your behalf or provide us with an executed power of attorney. You will also be required to submit both your and the authorized agent’s valid government-issued identification.

 

How to Appeal a Denial of a Request for Access, Correction, or Deletion of Personal Information

 

If Estate.Studio denies your request about your personal information, you may submit an appeal of the decision by completing the form located here.  You can also submit a request by emailing support@estate.studio. After you submit the request, you will be asked to verify your email address and submit reasonable additional information necessary to verify your identity as determined by us.

 

Once an appeal is submitted and your email is verified, the request and Estate.Studio’s response will be reviewed. In connection with this review, Estate.Studio may request that you submit additional information regarding your request. We will notify you of the outcome of the appeal within ninety (90) days.

 

Selling, Sharing, and Use of Personal Information for Targeted Advertising

 

Estate.Studio does not currently sell personal information to third parties. If in the future Estate.Studio does decide to sell personal information, any personal information collected prior to our update of this Privacy Policy will be excluded from such sale unless you otherwise consent to that additional use of the data.

 

Estate.Studio does engage in online marketing activities, including activities that may involve us sharing your information for purposes of showing you targeted advertising. If you would like to opt-out of the use of your personal information for these purposes, you should not use our Services and submit a request for your account to be terminated by emailing support@estate.studio.

 

  1. Right to Opt-Out of Personal Information Being Shared or Used In Targeted Advertising.

California requires that we notify you if we “Share” your personal information with third parties. In California, “Sharing” means we make available or otherwise disclose your information to third parties for cross-context behavioral advertising. Further, “cross-context behavioral advertising” means targeting of advertising to you based on your personal information obtained from your activity across businesses, websites, apps, and services other than our Services.

 

Similarly, privacy laws in other states require we notify you if we use your information for Targeted Advertising. Targeted Advertising means displaying advertisements to you where the advertisement is selected based on personal information obtained from your activities over time and across non-affiliated websites or online applications to predict your preferences or interests.

 

Accordingly, we “Share” your personal information with third parties for purposes of cross-contextual advertising, and we use your information for Targeted Advertising. Specifically, we share your identifiers and internet or other network activity with our advertising partners.

 

You have the right to opt out of “sharing” or Targeted Advertising.  To do so, you should not use our Services and should submit a request for your account to be terminated by emailing support@estate.studio.

 

  1. California Financial Incentive Disclosure. California’s privacy law requires that we notify you if we provide you a program, benefit, or other offering, related to the collection, deletion, or sale of personal information, which it defines as a “financial incentive.” We may offer you certain financial incentives that may result in different prices, rates, or quality levels (for example, contests and referral programs). Through these offerings, consumers provide us with some personal information (e.g., names, emails, phone numbers) when they opt-in to our programs. There is no obligation to opt-in and consumers may opt-out at any time. The details of each program are contained in the program offering. We offer these programs, among other things, to enhance our relationship with you so you can enjoy more of our products/Services at a lower price. We invest heavily in our marketing and brands, in part, so we can provide programs to our customers. Consumer data is valuable to our business only when it is combined with a sufficient number of other consumer data and after it is enhanced by our efforts herein described. The value to our business of any individual consumer’s personal information is dependent on a number of factors, including, for example, whether and to what extent you take advantage of any offerings, whether and to what extent you opt out of any offerings, and whether we are able to enhance the data through our efforts herein described. Our ability to create any value from the programs is heavily based on our ability to leverage said intellectual properties. We do not calculate the value of consumer data in our accounting statements.

 

  1. Changes to this Privacy Policy. We may change this Privacy Policy periodically. If we make changes, we’ll notify you by revising the date at the top of this policy and, in some cases, we may provide you with additional notice, such as adding a statement to our Site or sending you an email or other notification. We encourage you to review this policy regularly to stay informed about our information practices and the choices available to you.
